Terms of Service

1. Who we are

ITA Courier is operated by Teodor-Alexandru Ivanciu, trading as ITA Local Courier, a self-employed sole trader at 5 Lumley Place, Lincoln, LN5 7UT, United Kingdom. Contact: bookings@italocalcourier.co.uk, 07824 155849.

2. Booking request, confirmation and contract

Submitting a booking form, receiving an estimate or creating a payment session is a request only. It does not guarantee that a courier is available and does not by itself create a contract.

A booking becomes binding when ITA Local Courier confirms acceptance in writing and any payment or deposit required by that confirmation has been successfully received. A payment authorisation or automated acknowledgement sent before acceptance does not override this rule. If a request cannot be accepted, any amount captured for an unprovided service will be refunded.

The confirmation will identify the accepted service, collection and delivery details, price or pricing basis and the agreed date or pickup window. The customer should check it promptly and report any error.

3. Price and payment

ITA Pricing v2 is scheduled-only. Route prices use the road distance returned by Google for the accepted pickup and delivery route. Whole-mile prices from 1 to 10 miles follow the approved tariff below; distances between whole-mile anchors are calculated by the same Pricing v2 engine used for booking and payment. Distances above 10 miles use the approved service-specific v2 formula.

There is no standard waiting-time charge. Parking and toll charges, where applicable, are added at actual cost with proof.

Multi-drop — base customer prices for 1–10 miles: 1 mi £10.00 · 2 mi £10.50 · 3 mi £11.00 · 4 mi £11.50 · 5 mi £12.00 · 6 mi £13.00 · 7 mi £14.00 · 8 mi £15.00 · 9 mi £16.00 · 10 mi £17.00. The first delivery destination is included; each additional delivery drop is £3.00.

Restaurant hourly booking is £22.00 per hour with a minimum of 2 hours. 10 miles are included per booked hour, then £0.80 per additional mile. Waiting is covered by the booked hourly period and is not charged separately. Not VAT registered – no VAT charged.

Route pricing is based on the road route calculated for the accepted collection, delivery stops and any return leg that forms part of the confirmed job. Material changes requested after confirmation may require a revised price, which will be agreed before the additional work is carried out.

4. Customer responsibilities and item acceptance

The customer must provide accurate contact, collection, delivery and item information; ensure lawful and safe access; package items appropriately for ordinary courier transport; disclose fragile, valuable, temperature-sensitive or otherwise special items before confirmation; and avoid all prohibited items.

ITA Local Courier may refuse an item that appears unsafe, unlawful, prohibited, inadequately packaged, materially different from the booking description or unsuitable for the available vehicle. Refusal for one of these reasons does not remove any statutory rights and any charge will be limited to fair costs already incurred where the customer was responsible for the problem.

5. Prepared food deliveries

Food work is delivery-only for prepared and appropriately packaged food supplied by the relevant food business or customer. The supplier remains responsible for preparation, food safety, sealing, labelling and allergen information. ITA Local Courier does not prepare, open or repackage food and may refuse unsafe, leaking, damaged or incorrectly packaged items.

6. Collection, delivery and proof

The customer must make sure an authorised person can provide and receive the item at the agreed locations. ITA Local Courier may use reasonable proof of collection or delivery, such as status records, timestamps, a recipient name, PIN, signature or photograph where appropriate and lawful.

An item will not be left in a safe place or with a neighbour unless that instruction has been authorised by the customer or recipient and it is reasonable and safe to follow. Where such an instruction is followed correctly, the item is treated as delivered at the authorised location.

7. Delays and failed delivery

Pickup and delivery times are estimates unless a specific commitment is expressly confirmed in writing. Reasonable care and skill will be used, but traffic, road closures, weather, access restrictions, incidents and other circumstances can affect timing.

If the recipient is unavailable, ITA Local Courier will normally attempt to contact the customer or recipient and may wait for up to 10 minutes where it is safe and practical to do so. The item may then be returned to the sender or taken to another location only where agreed. Any redelivery or return charge must be reasonable, proportionate and communicated before additional chargeable work where practicable.

8. Changes, cancellation and consumer cancellation rights

Before acceptance, a booking request may be withdrawn without charge. After acceptance, cancellation and refund treatment is set out in the Cancellation and Refund Policy and any charge will reflect reasonable loss or work already supplied rather than operate as an automatic penalty.

Where a consumer has a statutory cancellation right for a distance service contract, that right is not excluded. If the consumer asks ITA Local Courier to begin the service during the statutory cancellation period, the consumer may be required to pay a proportionate amount for service supplied before cancellation where the law permits. If the service is fully performed during that period after the consumer's express request and acknowledgement that the cancellation right will be lost on full performance, the statutory right to cancel may end when performance is complete.

9. Loss, damage and complaints

The customer should report suspected loss, damage, misdelivery or another service problem as soon as reasonably possible, with the booking reference and any available photographs, receipts or other evidence. Reporting within 48 hours where practical helps preserve evidence, but this is not a contractual cut-off that removes statutory rights.

High-value, fragile or unusual items must be declared before confirmation so that suitability and any relevant cover can be checked. ITA Local Courier may decline a booking where the risk or available cover is not appropriate. The customer should not assume that an undeclared item is insured for its full value.

10. Liability

Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights and remedies that consumer law does not allow a trader to exclude.

Subject to those protections, ITA Local Courier is responsible for reasonably foreseeable direct loss caused by failure to use reasonable care and skill or another breach of the accepted contract. ITA Local Courier is not responsible for loss caused by inaccurate customer instructions, prohibited or undisclosed contents, inadequate packaging supplied by the customer, an authorised safe-place instruction followed correctly, or events outside reasonable control except to the extent the law provides otherwise.

For business customers, liability for indirect or consequential business losses such as loss of profit, revenue or opportunity is excluded to the extent permitted by law. Any specific declared-value or insurance limit agreed for a job will be stated in the booking confirmation rather than hidden in these general terms.

11. Complaints

Complaints should be sent to bookings@italocalcourier.co.uk with the booking reference and relevant details. ITA Local Courier will review the information and respond as soon as reasonably practicable. The Complaints page contains the current complaints process.

12. Law and statutory rights

These terms are governed by the laws of England and Wales. Statutory consumer rights are not affected. If any provision is found unenforceable, the remaining provisions continue to apply so far as legally possible.
